General contract and travel conditions for PT. PEI Effective from 1 September 2024

  1. These general contract and travel conditions regulate the legal relationship between you, our valued customer, and the PT. PEI for travel arrangements offered and/or organized through PT. PEI.
  2. Booking Conditions
    1. 2.1 Bookings
      All bookings shall be made via email. Please include your name, date of the cruise, the number of places reserved, the names of the passengers (as listed in their passport) and any special requests.
      By booking for a Cruise Package, the person making the Booking confirms, agrees and accepts that all persons named in the Booking request and on the invoice have agreed to be bound by the Booking Terms & Conditions. The person making the booking also confirms that he/she has authority to accept these Booking Terms & Conditions on behalf of all the persons listed on the Booking request and on the invoiceEach Cruise Package is subject to availability at the time of booking.
      To receive confirmation of your booking please follow the Payment Conditions outlined in clause 4. We reserve the right to consider the contract cancelled (in accordance with our cancellations conditions in clause 5.) if any payment is not received on time
    2. 2.2 Children and Teenagers
      1. 2.2.1 We strongly advise against traveling with children, as MLO is unsuitable for young guests. The vessels lack safety features and appropriate facilities or entertainment for children.
      2. 2.2.2 PT PEI assumes no responsibility for the care or safety of children or teenagers, which rests solely with their parents or guardians.
      3. 2.2.3 Parents or guardians traveling with minors must agree to and sign a disclaimer and liability release form at the time of booking.
  3. Passport and Visas
    1. 3.1 Passengers must hold fully valid passports for the whole duration of the Package and the expiry date must be at least 6 months after the return date.
    2. 3.2 The Company is not responsible for obtaining visas for any Passenger, this is the responsibility of the individual Passenger.
      It is the duty of the Passenger to verify that his/her passport, visas, or other documents for travel are accepted in the countries where the Package is deployed. Passengers are strongly advised to check for all legal requirements for travelling abroad and at the various ports to include the requirement of visas, immigration, custom and health.
  4. Services
    1. 4.1
    2. Our services are provided as described in our travel brochures, on our website and in travel agent advertisements. Special requests will only be considered part of the contract if they are acknowledged in writing by your booking agency. Unless otherwise specified, the services of PT. PEI begin at the designated port of embarkation. You are responsible for arranging your own transportation to these locations and ensuring your timely arrival.
    3. 4.2 Inclusions
      • Transfers from and to the airport or hotel at the embarkation location to/from Malaillo Liveaboard
      • Accommodation on board in double or twin bed. Cabin with ensuite shower, toilet and AC.
      • Full board including unlimited drinking water on board (excluding; soft drink, wine and spirits)
      • Up to four dives per day (no diving on embarkation and disembarkation day) accompanied by qualified dive guides. Missed dives do not result in a reimbursement claim.
      • Nitrox fillings for certified enriched air nitrox divers (courses available on request and subject to additional charges)
      • Weights and weight belts
      • Cruise director on board
      • All offered excursions
    4. 4.3 Exclusions
      • Pre- or post-cruise hotels and flights
      • Excess luggage charges (for both domestic and international flights)
      • National marine park fees (prices subject to change according to local government regulations and without prior notice
      • Fuel surcharges and harbour fees (prices subject to change according to government regulations, market prices and without prior notice
      • Long-distance cruise fuel surcharge
      • Dive rental gear
      • Dive courses
      • Dive and travel insurance (we recommend: DAN & www.travelguard.com)
      • Crew gratuities (we recommend a minimum of US$ 20 per day per guest)
      • Soft drink & Alcoholic beverages
  5. Prices and terms of payment
    1. 5.1 Prices
      Prices for trip arrangements are based on the price list of PT. PEI. Unless otherwise stated, prices apply:

      • Per Person, in Cabin with Double or Twin bed
      • In US Dollar5.2 Deposit and payment of balance for individual bookings

      A 20% deposit of the total amount is due and payable by the passenger to PT PEI, within 10 days from the date of the booking confirmation.
      Full payment is required no later than 90 days prior to the Cruise departure date.
      If the booking application is made within 90 days prior to departure, the full payment must be sent at the time of booking.If the payment is not received within the Terms & Conditions, the booking will be considered cancelled, the services will not be provided, and levy cancellation charges in accordance with clause 5 ff

    2. 5.3 Deposit and payment of balance for part or full charters
      For part or full charter reservations, a second pre-payment of 30% of the total price is due 180 days before the departure date. The remaining balance must be paid no later than 90 days before the departure date.
  6. Cancellation policy
    1. 6.1 Cancellation of an individual booking
      For cancellations received before departure, the following charges apply:

      • More than 90 days prior to departure: 20% of the total invoice
      • 89 to 60 days prior to departure: 50% of the total invoice
      • 59 to 0 days prior to departure or non-show: 100% of total invoice

      Changing of a cruise date is treated as a cancellation and new booking, and the applicable cancellation fees mentioned above will apply.
      If one of two guests sharing a double cabin cancels their reservation 30 or more days before departure, the 20% deposit will be forfeited. Additionally, a single cabin supplement will apply to the booking for the remaining guest.6.2 Cancellation of a part or full charters
      For cancellations received before departure, the following charges apply:

      • More than 180 days prior to departure: 20% of total invoice
      • 180 to 91 days prior to departure: 50% of total invoice
      • 90 to 0 days prior to departure or non-show: 100% of total invoice
    2. 6.3 Substitute Passenger
      The Passenger is entitled to replace himself with a third party, provided that:

      • The said third party satisfies all the conditions for the use of the Package
      • Written notice is duly sent to PT. PEI no later than 3 days prior to the Cruise departure

      If the conditions stated above in this clause are met, the name change will in any case be subject to a handling fee of USD 250.00- per person.
      PT. PEI cannot in any way be held responsible for any costs or changes related to external arrangements such as hotels or flights

    3. 6.4 Cruise cancellation or changes of itinerary by PT. PEI.
      1. 6.4.1 Cancellations due to Customer Actions
        PT. PEI. reserves the right to cancel a booking if the customer’s actions provide justifiable cause. In such cases, PT. PEI will refund any payments already made. Further claims against PT. PEI are excluded. The customer will be responsible for cancellation costs as stipulated in section 6.1
      2. 6.4.2 Minimum number of customers
        For all cruises offered by PT. PEI. a minimum of 8 participating customers is required. In case the minimum number of customers is not reached, PT. PEI. reserves the right to cancel the trip up to a maximum of 3 weeks prior to the departure date. In such a case, an alternative program will be proposed. If this is not possible, or you decline the proposal, PT. PEI. will reimburse all payments made up to that date. No additional compensation will be provided.
      3. 6.4.3 Force Majeure and unpredictable acts of man.
        PT. PEI. reserves the right to cancel a trip due to Force Majeure (i.e. natural disasters, epidemics etc.) or unavoidable acts of man (i.e. war, riots, strikes etc.) that would significantly hinder the success of the trip or endanger customer safety. If such a situation arises, PT. PEI. will advise you at the earliest possible date.
      4. 6.4.4 Trip cancellations due to other reasons by PT. PEI.
        PT. PEI. reserves the right to cancel a trip for other unavoidable reasons and will inform the customer at the earliest possible date.
      5. 6.4.5 Changes to itinerary and services
        In the event of significant changes to the itinerary that substantially alter the prearranged schedule (e.g., due to weather conditions), PT. PEI. will offer monetary compensation reflecting the difference between the agreed price for the cruise and the value of the services not provided.
    4. 6.5 Trip cancellation insurance
      PT. PEI. strongly advises purchasing supplementary insurance coverage for trip cancellations. Additionally, PT. PEI. recommends securing other types of insurance, such as luggage insurance, travel medical and dive insurance, and medical emergency evacuation insurance.
  7. Disabilities
    The Company’s priority is always the comfort and safety of its Passengers.
    The passenger must declare at the time of booking that they do not suffer from any mental, physical, or other disabilities that may put them, or other passengers at risk. PT PEI reserves the right to refuse services to any passenger presenting these risks.
    The Company reserves the right to refuse to carry any Passenger who in the opinion of the Company is unfit for travel or whose condition may constitute a danger to themselves or others on the Cruise on the grounds of safety.
  8. Damages resulting from personal injury, illness or death
    PT. PEI. assumes no liability for illness, personal injuries, or death sustained during any trip, whether due to the operation, maintenance, use, or control of any aircraft, helicopter, automobile, bicycle, boat, vehicle, hotel, common carrier, or other modes of transport used during the trip. Any services provided by third-party owners, operators, or public carriers for or on behalf of PT. PEI. are beyond the company’s liability.
    PT. PEI. shall not be responsible for any injury to person (whether resulting in death or not) or damage to property arising from acts of war, insurrection, revolt, civil uprising or military action occurring in any country of origin, destination or during passage.
    In the event of a medical problem during the cruise, either onboard or onshore, which results in costs for evacuation, the use of aircraft, or repatriation, the responsibility for payment of these costs rests solely with the passenger.
  9. Luggage and Prohibited Items
    1. 9.1 Luggage must comply with airline regulations, government security requirements, and ground operator policies. Each adult guest may bring personal items necessary for the cruise, including clothing, toiletries, and similar belongings. However, PT PEI strongly recommends packing in soft bags rather than hard, bulky luggage to facilitate storage onboard.
    2. 9.2 Guests are strictly prohibited from bringing any illegal substances, drugs, fireworks, weapons, firearms, explosives, or other hazardous items onboard. PT PEI reserves the right to deny boarding or disembark any guest found with prohibited items at their own expense, with no compensation or refund.
